You must agree to the below terms of service before you can create your CamNet UK Web account or use any of our services. Our shopping cart will not permit you to make any purchases unless you agree to the below terms of service.

 

CamNet UK may also be known as CamNetUK, Hypnotic Monkey, CNUK, or CNUK Hosting. CamNet UK may also be referred to as “we” “us” or “our” as the context permits.

 

Our terms of service (TOS, Terms of Service) are designed to provided to our customers a clear and transparent understanding of what we expect of them while they are using our service(s). The use of CamNet UK service(s) represents your acceptance and agreement to CamNet UK’s (TOS), regardless of whether you have read them or not.

 

We accept your use of our service(s); therefore we do not actively monitor your accounts activity under normal conditions. Furthermore, we do not implement editorial control over the content of any Web site. This includes e-mail sending, newsgroup or other material created or available over or through the services, except for certain proprietary Web sites. However, in accordance with our (TOS), we hold full authority to remove any materials that, in our individual judgment, may be illegal, may subject us to liability or which may violate our (TOS). CamNet UK reserves the right to oblige with legal establishment and/or third parties in the examination of any suspected or alleged crime or civil wrongdoing. Violation of our (TOS) may result in the suspension or immediate termination of your CamNet UK account and/or services.

 

We do not routinely monitor the activity of accounts except for measurements of system exploitation, possible security or fraud risks and the preparation of billing records. However, in our efforts to promote good citizenship within the Internet society, we will respond appropriately if we become aware of improper use of our service.

 

If a CamNet UK account is used to violate our (TOS) we reserve the right to cease your service without notice. We prefer to advise customers of inapt activities and any necessary corrective action. However, blatant violations of the (TOS) will result in instantaneous termination of service. Our failure to implement this policy, for whatever reason, shall not be interpreted as a waiver of our right to do so at any time.

 

As a member of our hosting community, you must use your hosting account access ethically and responsibly.

 

Unless otherwise agreed by us, all accounts and services are unmanaged. They come with no operating system, software and/or control panel installed, except in the case of shared hosting where a control panel will be provided. Shared web hosting comes with limited support, and VPS/Dedicated servers come with no support.

 

Prices are correct at time of posting and are subject to change without notice. We reserve the right to change our terms and conditions at any point without notice.

1) Account Setup

We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s). Just because we have received payment does not mean your order has been accepted. All accepted orders are usually activated within 72 hours. However in some cases it can take longer.

 

2) Content and Activities

All services provided by CamNet UK may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene. The customer agrees to indemnify and hold harmless CamNet UK from any claims resulting from the use of our services.

 

Examples of Unacceptable material (reason to suspend or terminate an account):

Warez Sites.

MP3’s (unless you are the artist or hold copyright).

Password sharing sites.

Sites that run any type of proxy script.

Pirated Software.

Hacked programs and archives.

Pornography.

Spam bots.

 

2.1) Distribution of Malicious Code:

Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data and/or computer systems are prohibited. Examples of this are computer viruses, Trojan-horse programs, Spam Bots and Internet-based worms. Such an offense will result in the immediate termination of the offending account.

 

2.2) Infringement

Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right: Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated. It is not permitted to use of the CamNet UK to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources and the unauthorized transmittal of copyrighted software.

 

2.3) File Hosting

File hosting and file storage of any type is strictly prohibited on any and all shared hosting servers within the CamNet UK network. You MAY NOT use your CamNet UK account as a download or file storage repository. Our services are strictly offered for website hosting only. This does NOT mean that you can not have downloads on your site. This means you can not operate a site that specializes in downloads like Download.com or similar and you may not use your CamNet UK account as storage repository for MP3, games, video, audio or music files. Your account may not exceed 20% of used space in MP3, games, video, audio or music files.

 

2.4) Adult Sites

Due to various legal and moral implications. CamNet UK does not permit sexually explicit material on any of its servers.

 

3) E-mail and Spam policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists” and “double Opt-in” will be treated as spam. Any user who sends out spam will have their account terminated without notice.

CamNet UK reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. CamNet UK also reserves the right to make any such modifications in an emergency at our sole discretion.

 

CamNet UK reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of CamNet UK. Bulk Email / Mass Email scripts of any type are not permitted on any CamNet UK server.

 

3.1) Usenet Spamming

CamNet UK has a zero tolerance policy for the use of its servers for the posting of messages or commercial advertisements, which violate the rules, regulations, FAQ or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.

 

4) Payment Information

You agree to supply appropriate payment for the services received from CamNet UK, in advance of the time period during which such services are provided. You agree that until and unless you notify CamNet UK of your desire to cancel any or all services received, those services will be billed on a recurring basis.

 

5) Data Loss and Backups

Your use of the CamNet UK service is at your own risk. CamNet UK is not responsible for any and all files and data residing on your account on our servers. CamNet UK does not maintain backup copies of customers web sites, data, servers, databases or e-mails. CamNet UK cannot guarantee that the contents of a Web site will never be deleted or corrupted, or that a backup of a web site will be available. You agree to take full and sole responsibility for any and all files and data transferred to our servers and to maintain all appropriate backups of any any and all files and data stored on any CamNet UK server to which you have an account on. We reserve the right to make unencrypted backups at any time, and transfer them to a remote server at a location of our choosing (including to another country to which the data was originally located e.g. data stored on a server in Europe may be backed up to a server in the USA).

 

5.1) Termination of Data

For your privacy, all data and files from terminated and cancelled accounts may be deleted and purged from our servers. Please make sure to back up all your files and data before canceling your CamNet UK account.

 

5.2) Emergencies and Special Situations

We reserve the right to take any proactive steps we deem necessary to maintain the security, connectivity, performance and services of our network, infrastructure and customers, including but not limited to actions requiring us to deactivate web sites or servers, shut down our network, or review the content on web sites to evaluate the reason for perceived behaviors. In rare instances, we may need to completely delete a web site, server or account because of some significant failure, security breach or other emergency. In such cases, we do our best to backup a deleted web site or server, but we cannot ever guarantee a full or even partial restore of a web site.

 

5.3) Account Security

Misuse of your account is your sole responsibility, even if your friends, family member, guest, or employee committed the activity. Henceforth, you must take actions to ensure that others do not gain access, which you do not approve of, to your account. In addition, you may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server.

Your password provides access to your account. It is your responsibility to keep your password secure. We are not responsible for ANY misuse of your account due to the authorized or unauthorized distribution of your password.

Sharing your password and account access with unauthorized users is prohibited. You should take precautions to prevent others from using your account since you will be held responsible for such use.

Attempting to obtain another user’s account password is strictly prohibited and may result in termination of service. You must adopt adequate security measures to prevent or minimize unauthorized use of your account.

You must not use the password you choose for your account on any other account or system. This includes but is not limited to software, websites, servers or computers.

 

Users who violate systems or network security may incur unlawful or civil liability. CamNet UK will oblige fully with examinations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

 

While we do not actively check or monitor the content of hosted files, we reserve the right to run any security and/or performance test, and to check the source code of clients websites or files hosted on our servers to identify any possible vulnerabilities or exploits should we feel there could be or are made aware of a possible security risk.

6) Cancellation and Refund Policy

All sales are considered final and non refundable unless specifically stated in the money back guarantee below, and we do not prorate any part of our billing fees for any unused time. We offer trials for some of our products so are advised to get a trial before ordering.

 

If you have a monthly contact, You may cancel your CamNet UK account at any time you desire provided you give 1 months notice. If you joined with PayPal, please login to your PayPal account and cancel your subscription agreement AFTER cancelling your package in our client portal. If you joined with DirectDebit/GoCardless, please login to your GoCardless account and cancel your subscription agreement AFTER cancelling your package in our client portal. Alternatively, submit a cancellation request to our customer support help desk.

 

If you cancel your CamNet UK account you are entitled to keep the domain that we have registered for you on your behalf. The domain Owner is you, you will be able to transfer the domain to your new domain host or registrar. You will be responsible for all transfer costs.

 

If you joined CamNet UK via the yearly payment option or have a 12 month contract and you cancel before the year has expired. You will be required to pay for the full contract term unless by prior agreement with CamNet UK.

Should we decide to terminate your account early, where possible we will give you 1 months notice of termination. If you paid for the year in advance and we terminate your account, we will credit you for the remaining amount of time left on the contract. Only full months remaining will be credited.

 

For Dedicated Servers Leasing, the cancelation notice should be for more than 60 days. If you request a cancelation in less than 30 days, you will also be charged for the next billing cycle of this Service. If for any reason, the payment is not applied, all domains, services you might have, will be kept by CamNet UK.

 

If you joined CamNet UK via the monthly payment option. Your account will be terminated 30 days after your last payment was received by CamNet UK.

 

CamNet UK will treat all files and data of terminated accounts exactly as outlined in the above clause 5.1.

 

We reserve the right to cancel and terminate accounts at any point, for any reason.

 

6.1) Cancellation for lack of payment

Any account that has any unpaid invoices more than 3 days outstanding may be terminated at any time without notice.

 

7) Refusal of Service

CamNet UK reserves the right to refuse service at its discretion. CamNet UK reserve the right to cancel, suspend or terminate any account at anytime as it sees fit. For services with an annual contract we will try to give 1 months notice of termination, however this is not always possible.  CamNet UK will treat all files and data of terminated accounts exactly as outlined in the above clause 5.1.

 

8) Domains Policy

 

Applies to all domain names.

 

8.1) Domain Name Transfer

All CamNet UK customers are responsible for domain transfer costs to our servers. You will retain ownership and responsibility of domains transfered to our servers.

 

8.2) CamNet UK’s Domain Name Transfer Away Policy

You may transfer away from CamNet UK any domain name that you have purchased via the CamNet UK online ordering system to any other web hosting company or domain registrar at any time you desire providing the domain name is fully paid up, has not been refunded, has not been charged back and does not have any active or outstanding invoices due and is not in redemption. You will be responsible for all transfer costs away from our servers.

 

9) Search Engines Submission

You are responsible for all search engine submissions for your hosting. If you do not wish for your site to be submitted click here.

 

10) Resource Usage

 

Users may not initiate the following:

 

a) Use 6% or more of system resources (This included CPU and memory) There

are numerous activities that could cause such problems; these include: CGI

scripts, FTP, PHP, HTTP, etc. If this clause is breached it will trigger an auto

kill failsafe mechanism on the server which will auto suspend the violating

account.

b) Run any type of interactive real-time chat applications that require server

resources. Remotely-hosted services are permitted.

c) Run stand-alone, unattended server-side processes at any point in time

on the server. This includes any and all daemons, such as IRCD.

d) Run any software that interfaces with an IRC (Internet Relay Chat) network.

e) Offer services to third parties that are run off of CamNet UK’s servers.

f) Run any gaming servers or games scripts for single or multi player games.

g) Run an email server offering free or paid email accounts to the general public.

Example: Hotmail, Yahoo Mail, GMail ,etc…

H) Operate a online radio and or movie service that uses our servers.

 

11) Bandwidth Usage

 

11.1) Account Usage (Domain Names)

CamNet UK standard web hosting offer (permits) you to host several domain names under a single account with a single control panel based on your Service.

 

This means that your account has one master domain name and all additional domain names are considered add-on domains. All your domain names must be administered from a single control panel. Only one control panel is allowed per account.

 

You are not permitted to…

a) Resell web hosting space. (if this is not a reseller account)

b) Create accounts for third parties. All domain names that are in your control

panel must be under your direct control and administration. You are not

permitted to create accounts for third parties on you account.

c) Have multiple control panels (CPanel’s) or (WHM) Web Hosting Manager on

a standard account.

 

11.2) Customer Knowledge & Responsibilities

Use of CamNet UK services requires a certain level of knowledge in the use of certain internet languages, slang, jargon, terminology, protocols, software, ETC… The level of knowledge customer required to have varies greatly and depends on the customers anticipated use and desired content and functionality of his/hers website. The customer agrees that he/she has the necessary knowledge to create his/hers website with the desired content, look and functionality. The customer agrees that it is not the responsibility of CamNet UK to provide this knowledge or to create, design, program or help in the designing, creation, programming or publishing of the customers website.

 

11.3) SSH, Root and Shell Access

We do not permit Shell, Telnet, SSH or root access to any of our shared servers.

 

12) Prices Change Policy

 

From time to time we may need to adjust the price of products or services provided by CamNet UK. We reserve the right to change prices listed on CamNet UK, and the right to increase or decrease the amount of resources given to plans at any time. If the price of your current package is increased we will give you a minimum of 28 days notice prior to your next invoice date. You are required to pay the new amount for the remainder of your contract provided any increase is less than £5 or 10%, whichever is highest.

 

12.1) Auto Rebilling

For your convenience your CamNet UK account will auto rebill on a monthly, quarterly, semi-annually, annually, biannual or tri-annual basis, (depending on which billing package you have selected at time of purchase). If you do not want your account to auto rebill, you must notify us at least 7 calendar days (168 hours) before the date that the re-billing is due to take place. Failure on your part to notify us of your desire not to be rebilled, will result in your account being rebilled and you agree to hold harmless and indemnify CamNet UK from any and all claims of wrongful billing.

 

13) Indemnification

 

13a) Customer agrees that it shall defend, indemnify, save and hold CamNet UK harmless from any and all demands, liabilities, losses, costs and claims, including any and all attorney’s fees asserted against CamNet UK, its owners, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless CamNet UK against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with CamNet UK; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from a CamNet UK server.

 

13b) IF LAWSUIT(S) ARE THREATENED AGAINST CamNet UK. If we are sued or threatened with lawsuit in connection with Service(s) provided to you, we may turn to you to indemnify us and to hold us harmless from the claims and expenses (including attorney’s fees and court costs). Under such circumstances, you agree that you will, upon demand, obtain a performance bond with a reputable bonding company or, if you are unable to obtain a performance bond, that you will deposit money with us to pay for our reasonably anticipated expenses in relation to the matter for the coming year(s). Such deposit will be drawn down as expenses that are incurred, with all account notices sent to the WHOIS contact information provided in association with your domain names and/or account. We shall not be obliged to extend you any credit in relation to such expenses and we may terminate our services for a failure to make or renew such a deposit. We will return any unused deposit upon the later of one year from deposit or the conclusion of the matter.

 

CamNet UK will not be responsible for any damages your business may suffer. CamNet UK makes no warranties of any kind, expressed or implied for services we provide. CamNet UK disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non deliveries, hardware and software failures, hacking, sabotage, terrorist attacks, wrong delivery, Force Majore and any and all service interruptions caused by CamNet UK and its employees.

CamNet UK reserve the right to revise, alter and update our terms of service without notice at anytime at its sole discretion and can apply any and all changes and updates retroactively.

 

14) Disclaimer

Paypal is an authorized payment solution for CamNet UK.

 

Directadmin, cPanel, ISPConfig and all software installed via these are third party software, and we are not responsible for any bugs, Problems or intrution/dataloss you may have due to that Application.

 

Any further terms of Service linked after this article, are extension part of Terms of Service, and these are also considered as Terms of Service, by reading them or not.

Service Level Agreement (SLA):

Maintenance Procedure

1. CamNet UK will do it’s best to announce any scheduled maintenance at least 24 hours ahead of time to the customer.

2. CamNet UK reserved the right to perform maintenance without any prior notification, should it be deemed necessary by us.

 

Conditions

Customer shall not receive any credits under this SLA in connection with any failure of deficiency of Service Availability. This includes incidents caused by but not limited to:

  1. 1) Circumstances beyond CamNet UK’s reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, armed conflict, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of or interruption or delay in telecommunications or third party services, virus attacks or hackers, failure of third party software (including, without limitation, ecommerce software, payment gateways, chat, statistics or free scripts) or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of this SLA;
  2. 2) Failure of access circuits to the CamNet UK’s Network or it’s upstream providers;
  3. 3) Scheduled maintenance and unscheduled or emergency maintenance and upgrades;
  4. 4) DNS issues outside the direct control of CamNet UK
  5. 5) Customer’s acts or omissions (or acts or omissions of others engaged or authorized by customer), including, without limitation, custom scripting or coding (e.g., CGI, Perl, HTML, ASP, etc), any negligence, willful misconduct, or use of the Services in breach of CamNet UK’s Terms of Service and Acceptable Use Policy
  6. 6) E-mail or webmail delivery and transmission;
  7. 7) DNS (Domain Name Server) Propagation;
  8. 8) Outages elsewhere on the Internet that hinder access to your account. CamNet UK is not responsible for browser or DNS caching that may make your site appear inaccessible when others can still access it. CamNet UK will guarantee only those areas considered under the control of CamNet UK.

 

Subscriber further acknowledges that the company’s liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

 

Credit Request and Payment Procedures

In order to receive a credit, customer must make a request therefore by submitting a Support ticket from within the Customer Support Portal at http://my.camnetuk.com In order to validate such claims customers must be logged into the portal at the time of submission. Each request in connection with this SLA must include customer’s account name (per customer’s control panel login) and the details of package termination and must be received by CamNet UK within ten (10) business days after customer’s package was terminated. If the termination is confirmed by CamNet UK (and appointed third parties), credits will be applied within two months after CamNet UK’s receipt of customer’s credit request. Credits are not refundable and can be used only towards future billing charges.

 

Not with standing anything to the contrary here in, the total amount credited to customer in a particular month under this SLA shall not exceed the total hosting fee paid by customer for such month for the terminated Services. Credits are exclusive of any applicable taxes charged to customer or collected by CamNet UK and are customer’s sole and exclusive remedy with respect to any termination.

 

Note: Credits are not refundable and can be used only towards future billing charges.

 

2. Customer Support

CamNet UK wants to achieve the best support for our customers.

In order to achieve this, we guarantee:

 

  1. a) To give priority to Emergency Tickets (once a ticked is received we will decide if a ticket can be classed as an emergency, this decision is final).

 

All support requests must be made via Support Ticket.

 

Due to varying support requests, levels and agreements, we cannot guarantee a response to any support request or ticket.

 

If you provide us with access to any account or server, you agree you have made full backups of your files and data before providing us with login details. We will not be held responsible or liable for any loss of data. You must only provide us with access to accounts and/or servers when it is requested by us.

If you are providing us with login credentials, these must be temporary credentials with the minimum required access (least-privileged user account) e.g. if we are providing module support and require file access, provide a temporary FTP account which is restricted to the module directory NOT full root access.

You must not provide us with login credentials that have access your client data as this will never be required by us.

 

3. Money Back Guarantee

 

We are proud for our services and we offer refund, without questions, for all of our shared web hosting.

 

Refund Rules:

  • Refund can be requested only once per client account.
  • It covers all our shared web hosting services and the refund days are based on payment period:
    • All hosting packages you have 30 days period to request refund
  • Free domains will be charged if you request refund, based on our Domains Pricing.
  • If you have had a free trial of our services you are not entitled to a refund.
  • Refund applies to shared web hosting packages only.
  • If you have a custom shared web hosting package you are not entitled to a refund.

 

Items we cannot refund include but are not limited to:

  • 1. Domain names (domain names registration and payment are final)
  • 2. Extra IP Addresses
  • 3. SSL
  • 4. Setup fees
  • 5. Dedicated servers
  • 6. Control panel orders are not refundable. If your receive a Free or Discounted Control Panel you will be required to pay the full retail price,please contact us for our Control Panels Pricing.
  • 7. Addon Packages inc. installatron
  • 8. Virtual Servers (VPS)
  • Software
  • Websites, Coding and Development work

 

Free Domains & Ownership

  • a) All Domains even if this domains are free of charge, are owned by the customer.
  • b) Registration Details for domains are passed through customer’s account Information.

Fair Usage Policy

All products and items are subject to a fair usage policy – CamNetUK will decided what is considered fair usage. Bandwidth is not currently capped unless otherwise stated but if we decide your usage is outside what we consider to be fair we may place a cap on your account and/or charge for bandwidth used.

 

If you require more space or bandwidth then please submit a support ticket with the reason why you require more, and details of what you will be hosting. We will then decide whether to increase your capped limit or add a extra charge to your account. It will be our decision whether to add a higher limit to your account and whether to charge for it or not.

 

Design, Development and Software

Unless discussed and agreed prior to us commencing work, we keep all copyright to any items we produce including but not limited to code, images and databases. We reserve the right to reuse and redistribute any aspect of the work.

 

Unless arranged prior to purchase, all software, module, addons or any other type of coding is provided as is without warranty. We are not responsible for any loss or damaged caused by these products.

 

Some products or modules may have callbacks to our servers which will provide us with usage information. These include but are not limited to licence key, IP address, installation directory and domain. By using our products you are agreeing to these callbacks.

 

Privacy Policy

By agreeing to these Terms and Conditions you also agree to be bound by our Privacy Policy.
